TERMS OF SERVICE, LIMITED WARRANTY & LIABILITY RELEASE

These Terms apply to all services provided by Top Guard USA ("Company," "we," "us," or "our"), including but not limited to Premium/Maintenance Washes, Paint Refinement/Paint Correction, Ceramic Coating applications, and any related detailing or protection services.

By booking an appointment, making any payment (deposit or full), allowing us to perform services on your vehicle, or otherwise proceeding after receiving these Terms (via website, email, text, invoice, or verbal notice), you ("Customer" or "you") agree to be legally bound by these Terms of Service, Limited Warranty, and Liability Release. If you do not agree, do not proceed with services and contact us immediately to cancel.

1. Services Overview

We provide premium automotive detailing and protection services, including:

Premium / Maintenance Washes: Hand washing using safe, high-quality products and techniques (e.g., two-bucket method, microfiber tools, blow-dry, drying aids) to clean and preserve your vehicle's finish without causing damage or dulling.

Paint Refinement / Paint Correction: Multi-stage correction process to remove surface imperfections (swirls, scratches, oxidation, contaminants), restore deeper paint depth, clarity, gloss, and prepare the surface for protective coatings.

Ceramic Coatings: Professional-grade, long-lasting hydrophobic coating applications that provide UV protection, superior water beading, extreme chemical resistance (against bird droppings, tree sap, bugs, road salt, etc.), enhanced gloss and color depth, increased scratch/swirl resistance, easier maintenance, and defense against oxidation/fading.

Services are performed using industry-standard products and techniques at mutually agreed locations (shop, mobile/concierge, or other). Completion times vary based on vehicle condition, size, service scope, and external factors. We reserve the right to refuse or modify services if the vehicle presents safety hazards or undisclosed damage.

2. Payment & Booking

Pricing is quoted per vehicle/service and stated in your booking confirmation, quote, or invoice.

Deposits (typically 50%) secure your appointment; balance is due upon completion and before vehicle release.

Additional services requested must be approved in writing (email/text) and may incur extra charges.

We accept debit cards, credit card, cash. Late payments may incur fees.

3. Customer Representations & Obligations

You represent and warrant that:

You are the legal owner of the vehicle or have full authority to authorize all work.

You have disclosed (or had reasonable opportunity to disclose) any known issues, including thin clear coat, prior repairs, existing damage, aftermarket modifications, or hazardous conditions.

The vehicle is free of contraband, hazardous materials, or conditions that could endanger personnel or property.

You agree to:

Provide access (keys, codes, entry instructions) and retrieve the vehicle promptly upon completion (storage fees of $50/day may apply after 48 hours).

Follow all provided post-service care/maintenance instructions to maintain any warranty eligibility.

4. Limited Warranty

Ceramic Coatings: Warranted for 1-5 years depending on product/package against defects in application/materials, provided you follow our maintenance guidelines (supplied at delivery). Coverage is non-transferable and limited to reapplication of affected areas at our discretion.

Paint Refinement/Correction & Washes: These are corrective/enhancement processes with no warranty. Results vary based on original paint condition, thickness, and prior damage. We do not guarantee complete removal of all imperfections.

Warranty excludes damage from accidents, abuse, improper washing (e.g., automatic car washes, harsh chemicals), bird droppings left uncleaned, environmental factors, or failure to maintain the vehicle per guidelines. Proof of purchase and maintenance records required for claims.

5. LIABILITY RELEASE & WAIVER

IMPORTANT – READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS

Automotive detailing services, including washing, paint correction, and ceramic coating, involve chemicals, machine polishing, heat curing, handling, and other processes with inherent risks, such as:

Microscopic removal of clear coat during correction

Highlighting or revealing pre-existing defects, rock chips, thin paint, holograms, or imperfections

Minor marring, swirls, or effects on trim, glass, wheels, emblems, sensors, electronics, or interior if not removed/protected

Potential for incidental contact or environmental exposure during mobile services

BY PROCEEDING WITH SERVICES AS DESCRIBED ABOVE, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Top Guard USA, its owners, employees, agents, contractors, and affiliates (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action (known or unknown) arising from or related to the services. This includes (without limitation):

Any damage to the vehicle's paint, clear coat, body, wheels, glass, interior, electronics, or personal property left in the vehicle

Loss, theft, fire, vandalism, or damage while the vehicle is in our possession or control

Personal injury or property damage related to the services

Claims based on alleged ordinary negligence (this release does not apply to gross negligence, recklessness, willful misconduct, or intentional acts)

You agree to indemnify and hold harmless the Released Parties from any third-party claims, damages, losses, or expenses (including reasonable attorney fees) arising from or related to your vehicle or the services.

Our total liability (whether in contract, tort, warranty, or otherwise) shall not exceed the amount you actually paid for the specific services in question.

This release binds you, your heirs, executors, administrators, successors, and assigns.

6. General Provisions

These Terms constitute the entire agreement and supersede prior understandings. Modifications must be in writing and signed by us.

If any provision is invalid, the remainder remains enforceable.

Governing Law & Venue: California law applies. Any disputes shall be resolved exclusively in Orange County, California courts.

Force Majeure: We are not liable for delays or non-performance due to events beyond our control (e.g., weather, supply issues, illness).
